General Terms and Conditions and Code of Conduct – Thai Massage Sabai
1. Applicability
These general terms and conditions and rules of conduct apply to all treatments, appointments, reservations, offers, and agreements between Thai Massage Sabai and its clients. By making an appointment, booking a treatment, or purchasing a service, the client agrees to these terms and conditions.
2. Nature of the services
The treatments provided by Thai Massage Sabai are aimed at relaxation, well-being, and physical comfort. Our treatments are not intended as a substitute for medical care, medical advice, physiotherapy, diagnosis, or treatment by a doctor or other medical professional.
In the event of physical complaints, medical conditions, or doubt regarding the suitability of a treatment, the client must consult a doctor or specialist in advance.
3. Client’s duty to disclose
The client is obliged to provide all information prior to the start of the treatment that may be relevant for the safe and responsible execution of the treatment. This includes, but is not limited to:
high or low blood pressure;
cardiovascular complaints;
pregnancy or suspected pregnancy;
back, neck, muscle, or joint problems; recent surgeries or injuries;
use of medication;
skin conditions;
allergies;
dizziness, fainting, or neurological complaints;
other medical or physical conditions that may affect the treatment.
If the client does not provide this information, or does not provide it completely or in a timely manner, the treatment is performed entirely at the client's own risk.
4. Right to refuse, modify, or terminate treatment
Thai Massage Sabai reserves the right to refuse, modify, interrupt, or terminate a treatment with immediate effect if:
the client has not provided relevant medical information;
the practitioner doubts whether the treatment is medically responsible;
there are signs of illness, poor hygiene, aggression, intimidation, or other inappropriate behavior;
the client is under the influence of alcohol, drugs, or other substances;
the practitioner is of the opinion that continuing the treatment is irresponsible or unsafe.
In such cases, there is no right to compensation. If the cause lies with the client, Thai Massage Sabai may charge the full amount of the reserved treatment.
5. Communication during the treatment
The client is responsible for immediately indicating during the treatment when the pressure is too hard or too soft, when pain, dizziness, discomfort, or other complaints arise, or when the treatment needs to be adjusted or terminated. If the client fails to indicate this in a timely manner, Thai Massage Sabai cannot be held liable for this, except in cases of intent or gross negligence.
6. Rules of Conduct
We expect respectful and proper behavior from every client towards our staff and other people present.
The following will not be tolerated:
aggressive, insulting, or intimidating behavior;
inappropriate remarks or touches;
discriminatory behavior;
sexual innuendo or requests;
disturbing the peace or safety in the salon.
In the event of a violation of these rules of conduct, Thai Massage Sabai has the right to terminate the treatment immediately and to refuse the client access to future appointments. In that case, no refund will be given.
7. No erotic services
Thai Massage Sabai offers exclusively professional wellness and massage treatments. Erotic or sexual services are not offered. Requests, suggestions, or behavior in this regard will result in the immediate termination of the treatment without refund and may lead to the refusal of future bookings.
8. Rates and payment
All rates are in euros and apply as stated on the website, in the salon, or in the online booking environment. Thai Massage Sabai reserves the right to adjust rates at any time.
Payment must be made:
in advance via the online booking environment, or
immediately after the treatment, unless otherwise agreed.
Special offers, discount promotions, or packages cannot be combined, unless expressly stated otherwise.
9. Deposit
Thai Massage Sabai may require a deposit for new clients, certain treatments, specific times, or in other cases determined by the organization. An appointment is only confirmed once the requested deposit has been received. If a deposit has been made, it will be offset against the total amount of the treatment. In the event of late cancellation, no-show, or other situations as described in these terms and conditions, the deposit may be forfeited in whole or in part.
10. Cancellation and rescheduling of appointments
Appointments may be cancelled or rescheduled free of charge up to a maximum of 24 hours prior to the scheduled start time, unless Thai Massage Sabai explicitly applies a different timeframe for a specific service or promotion.
In the event of cancellation or rescheduling within 24 hours prior to the appointment, Thai Massage Sabai reserves the right to charge the full amount, a deposit, or a reasonable fee.
The client must communicate change or cancellation requests in a timely and clear manner.
11. Changes via email, message, or telephone
Requests for change or cancellation via email, contact form, SMS, WhatsApp, or other message are only valid after Thai Massage Sabai has explicitly confirmed them.
Our mailbox and messaging channels are not continuously monitored. Without confirmation, the original appointment remains in effect unchanged.
Changes or cancellations within 24 hours prior to the appointment must be communicated by telephone and are only valid after confirmation by Thai Massage Sabai.
12. No-show and lateness
If the client fails to appear for the appointment without timely cancellation, this counts as a no-show. In that case, Thai Massage Sabai is entitled to charge the full amount of the treatment or to retain the deposit or payment already made.
If the client arrives late, the treatment may be shortened so as not to disrupt the salon's schedule. In that case, the full rate remains due.
13. Prepaid treatments, credits, and goodwill
If a treatment has been prepaid and the client cancels or reschedules in a timely manner in accordance with these terms and conditions, Thai Massage Sabai may, at its own discretion:
offset the payment against a new appointment, or issue a credit, or issue a refund if there is cause to do so.
If Thai Massage Sabai decides to grant a credit in an individual case out of goodwill, the client cannot derive any rights from this for future cases.
14. No statutory right of withdrawal for appointments on a specific date/time
To the extent permitted by law, no statutory right of withdrawal applies to bookings of treatments on a specific date and time. This is clearly stated in advance at the time of booking.
15. Liability
Thai Massage Sabai performs treatments with the utmost care. However, every treatment remains dependent in part on the information provided by the client, the client's physical condition, and the body's reaction to the treatment.
Thai Massage Sabai is not liable for damage, injury, aggravation of symptoms, or other adverse consequences if:
the client has provided incorrect, incomplete, or no information regarding medical or physical conditions;
the client fails to follow advice or instructions from the practitioner;
there are pre-existing complaints, conditions, or sensitivities;
the treatment has been modified or continued at the client's request despite a warning or advice from the practitioner.
Any liability of Thai Massage Sabai is in all cases limited to the amount paid for the treatment in question, unless there is intent or gross negligence on the part of Thai Massage Sabai.
16. Complaints
Complaints regarding a treatment or the services provided must be reported to Thai Massage Sabai in writing or by email as soon as possible, and preferably within 48 hours after the treatment, with a clear description of the complaint.
Filing a complaint does not release the client from their payment obligation, unless Thai Massage Sabai expressly decides otherwise.
17. Privacy
Thai Massage Sabai treats personal data, contact details, and any shared health information confidentially and in accordance with applicable privacy legislation, including the GDPR. Data is used exclusively for the execution of the agreement, client contact, administration, and – where applicable – processing of bookings and payments.
Data will not be provided to third parties without a legal basis or the explicit consent of the client, except when this is necessary for the execution of the booking or payment.
18. Applicable Law
Dutch law applies exclusively to all agreements, treatments, and disputes between Thai Massage Sabai and the client.
